US egg producers move toward settlement in price coordination investigation
Proposed agreement would also end the exchange of pricing and other commercially sensitive market information.
USA – Major US egg producers are nearing a settlement with the US Department of Justice over allegations that they coordinated egg prices through an industry benchmarking system, according to a Bloomberg News report citing people familiar with the discussions.
The proposed agreement involves Cal-Maine Foods, Hickman’s Egg Ranch, and Versova, with each company expected to pay civil penalties worth several million US dollars, collectively donate more than 50 million eggs, and agree to stop sharing pricing data and other commercially sensitive information with competitors.
The settlement discussions follow a lawsuit filed by the Department of Justice in April, which accused the companies of using an industry price reporting service to coordinate prices in violation of competition laws, according to earlier reporting by The Wall Street Journal.
The legal action was brought by the federal government, together with a bipartisan coalition of US states, after authorities investigated whether information exchanged through the pricing service reduced competition in the country’s egg market.
Neither the Department of Justice nor the three egg producers immediately responded to media requests seeking comment on the reported settlement negotiations.
Price fixing claims
The investigation comes as US egg suppliers continue to face multiple class-action lawsuits alleging price-fixing, with consumers challenging whether companies unfairly increased prices during a period of elevated food inflation.
The legal scrutiny has intensified following sharp increases in egg prices over the past several years, as repeated outbreaks of highly pathogenic avian influenza have led to the loss of millions of laying hens, reducing supplies and contributing to higher retail prices across the country.
Industry participants have maintained that disease-related supply disruptions played a significant role in pushing prices higher as producers worked to rebuild flocks affected by the outbreaks.
US egg industry
The United States produces more than 100 billion eggs annually from a commercial flock of approximately 310 million laying hens, with each bird producing an average of about 300 eggs every year.
More than 93 billion of the country’s annual egg production is supplied as table eggs for human consumption, while the remaining output supports hatcheries that produce replacement laying hens and broiler chickens.
The industry supplies more than 80 million eggs each day, with Iowa, Ohio, Indiana, Pennsylvania, and Texas accounting for over 45% of total US egg production.
More than half of all shell eggs are sold through retail outlets, and the remainder is processed for food service and food manufacturing.
